Legal Aid

The Channel Island's legal profession provide a Legal Aid service for those who cannot afford a family lawyer or who are experiencing difficulties in finding one.

Legal Aid is normally only given to people who live in the Channel Islands. However, you may be eligible if you live elsewhere and have been charged with a criminal offence, or need legal advice in relation to a child who does live here. Legal Aid is not available for every type of dispute or problem though.

In Jersey, the lawyer appointed is entitled to charge you a reasonable fee in accordance with the Legal Aid guidlines. The guidelines include quite detailed rules about what you can be charged. These rules take into account your household income and capital as well as any settlement obtained in your case.

The lawyer appointed to help you will be the next lawyer on a rota which is administered by the Legal Aid Office.  Only in unusual circumstances will this not be the case. If the lawyer originally appointed cannot act for you then a new lawyer may have to be appointed.

In Guernsey, there are three types of legal aid available...

  • If a person is arrested or is a volunteer at the police station or customs, then they may consult the Duty Advocate who is on call 24 hours a day and is free of charge. The Duty Advocate is also available at most sittings of the Magistrates and Juvenile Courts for free consultation, excluding the Traffic Court and Petty Debts Court. If you choose your own advocate rather than the Duty Advocate then you must pay for that consultation yourself.
  • Under the Green Form, advice and assistance is limited to 2 hours and can be used to obtain advice, prepare a case, have representation at court, or prepare a legal document. Advice and assistance is means tested.
  • Full legal aid covers more complex cases and is both means and merit tested in most cases.


Legal aid is not available for any other matter outside the Islands.
